Corporate Volunteer Waiver

LIABILITY RELEASE AGREEMENT

Please read the following carefully. Your signature below indicates that you have read and understood every provision of this Agreement and that you unequivocally agree to all terms, conditions and promises herein.

I am about to participate in a volunteer activity or community event with Thompson Island Outward Bound Education Center (“TIOBEC”). I understand that TIOBEC is facilitating this activity or event to engage volunteers, alumni, and the community, to provide service, and to promote its programs. I am fully aware of all aspects of my volunteer service with TIOBEC, its facilities, and all associated risks. I have been given ample opportunity to ask any questions I have about the activities and the environments to which I may be exposed. As consideration for allowing me to participate as a volunteer with TIOBEC, I agree as follows:

ACKNOWLEDGEMENT AND ASSUMPTION OF RISK: I acknowledge and agree that my participation as a volunteer at TIOBEC is purely voluntary and involves associated risks. I understand that these risks can cause or lead to injury, illness, property damage, mental or emotional trauma, disability, or death. I understand that TIOBEC cannot ensure my safety, and that I am responsible for my safety. I agree to disclose any pertinent medical history with the activity leaders, and I will assess my own ability to safely participate before engaging in any activity. I accept and fully assume all risks of my activities.

PERMISSION TO USE PHOTOGRAPHS AND VIDEO: I hereby authorize and give full consent to TIOBEC to use, copyright, or public all photographs in which I appear while participating with TIOBEC. I further agree that TIOBEC may transfer, use, or cause to be used these photographs for any and all commercial and non-commercial uses, including but not limited to public displays, publications, commercials, art, and advertising, without limitations or reservations.

TIOBEC RULES: I agree to obey and follow all of TIOBEC’s rules and expectations as may have been communicated to me in writing or by staff before or during my volunteer service. I further understand and agree that TIOBEC, at its sole discretion and at any time, may remove, revise, suspend and/or add rules and expectations, and I agree to abide by any such changes.

RIGHT TO EXPEL: I understand and agree that TIOBEC reserves and retains the right, at its sole discretion, to cancel and expel me from volunteer service with TIOBEC for any reason at any time.

FORUM SELECTION AND CHOICE OF LAW: I understand that TIOBEC’s primary place of business is in Massachusetts. I agree that any legal claim or dispute that may arise from my service as a volunteer for TIOBEC or from this Agreement, shall be governed by the substantive laws of the State of Massachusetts and that any such dispute or lawsuit shall only be filed or brought in the Massachusetts state court in Suffolk County, MA.

INTEGRATION: I understand and agree that this Agreement is a fully integrated contract and supersedes any and all prior oral and/or written expressions by TIOBEC about my experience as a volunteer at TIOBEC.

SEVERABILITY: Any portion of this document deemed unlawful or unenforceable is severable and shall be stricken without any effect on the enforceability of the remaining provisions.

COVID-19: I agree to abide by the COVID-19 mitigation guidelines and requirements of the CDC and TIOBEC. I understand, agree, and accept that TIOBEC cannot ensure that the environments I will encounter during my activity or event will be safe from exposure to the SARS-CoV-2 virus. I assume any and all risks related to exposure to or contracting COVID-19 during my visit and I understand this could lead 1) to my illness, hospitalization, and possible death and 2) to me exposing others, including family and friends, to the virus.

RELEASE OF CLAIMS AND PROMISE NOT TO SUE: I hereby release and covenant not to sue TIOBEC, its affiliates and its chartering organization, Outward Bound, Inc. (“OB), from any and all liability, claims, demands, losses, suits, damages, or expenses associated with or arising from my participation in the activity or event, including any and all claims alleged for negligence, personal injury, illness, wrongful death, emotional distress and/or claims arising from emergency response, operations, and/or any medical care provided to me while participating with TIOBEC. I further agree to indemnify, defend, and hold harmless TIOBEC, its affiliates, OB, and other participants for any claim brought by me, my child, or any other person for a claim related to or arising from my participation in the activity or event.

I HAVE CAREFULLY READ, UNDERSTAND, AND VOLUNTARILY SIGN THIS DOCUMENT. I UNDERSTAND THAT I AM SURRENDERING CERTAIN LEGAL RIGHTS. BY SUBMITTING THE REQUESTED INFORMATION BELOW, I AGREE TO THE TERMS AND CONDITIONS IN THIS DOCUMENT.

If participant is under the age of 18 at the time this document is signed, a parent or legal guardian must sign the release in addition to the participant signing.
